1. Introduction

ArtistAssistApp ("Web App") provides artistic tools, including color mixing, photo manipulation, style transfer features, tonal value studies, and grid generation for accurate drawings. These services are designed to enhance artists' work by offering practical features for color accuracy, background removal, and photo-to-outline conversions.

The Web App is developed and operated by Yevhen (Eugene) Khyst, a sole trader based in Ukraine. The team of ArtistAssistApp is originally from Ukraine, and we operate globally, providing access to our services to users around the world.

2. Definitions

• Web App: The ArtistAssistApp platform available at https://app.artistassistapp.com, including all its features, tools, and content.
• Free Features: The limited set of tools available without subscription, including basic color brands and basic image processing modes.
• Premium Features: The complete set of features unlocked with a paid subscription, including 200+ color brands and advanced image processing modes.
• Subscription: A recurring payment agreement that grants access to Premium Features for a specified period.
• User: Any individual who accesses or uses the Web App.
• Content: Any information, data, text, images, or other materials uploaded, processed, or generated through the Web App.

3. Acceptance of Terms

By accessing or using the Web App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Web App.

If you are under the required minimum age in your jurisdiction, you must obtain parental or guardian consent to use the Web App. Users under the age of 13 are strictly prohibited from accessing or using the Web App under any circumstances.

4. Access and Subscriptions

4.1 Free Features

The Web App provides a set of features available to users at no cost. These Free Features are designed to allow users to explore and evaluate the functionality of the platform prior to committing to a paid subscription. Free Features may include, but are not limited to, basic image processing tools and limited access to color brands.

The scope of Free Features is subject to change at the sole discretion of ArtistAssistApp and may be modified, limited, or expanded without prior notice.

4.2 Paid Subscriptions

Users may choose to upgrade to a paid subscription plan, which grants access to Premium Features beyond those available through the Free Features. Premium Features include, but are not limited to:

• Access to over 200 color brands
• Advanced image-to-outline transformation mode
• Enhanced background removal capabilities
• Additional image style transfer options
• An entirely ad-free user experience

Subscription plans are offered on a monthly basis and are subject to the terms described in Section 4.3 ("Subscription Terms").

4.3 Subscription Terms

All subscriptions operate on a monthly billing cycle. This means that after the initial purchase, recurring payments will occur automatically every month unless the subscription is canceled prior to the next billing date.

You may cancel your subscription at any time through the Account page of the Web App or by contacting us via email at View email address. Cancellation of your subscription will prevent further charges. However, you will retain access to Premium Features until the end of the current billing cycle.

It is your responsibility to manage and review your subscription status prior to renewal. Canceling a subscription does not qualify for a refund unless it meets the conditions stated in our Refund Policy (see Section 5).

Any changes to subscription price will be posted on the Web App 30 days prior. Continued use after changes implies acceptance.

5. Refund Policy

We encourage all users to fully evaluate the Web App through its Free Features before committing to a paid subscription. This enables you to determine whether the Premium Features meet your needs.

Refund requests are only considered within 14 days from the date of initial purchase. However, refunds will not be granted if Premium Features have been used, including but not limited to accessing more than 200 color brands or utilizing any advanced image processing features (such as image-to-outline conversion, background removal, or style transfer).

To request a refund, please email our support team at View email address with your purchase information. All requests are evaluated on a case-by-case basis.

Some jurisdictions may provide additional consumer rights under applicable law. Where these rights apply, they will override specific parts of this refund policy to the extent required by law.

Please note: Refund requests are distinct from subscription cancellations. Canceling your subscription will prevent further billing but does not entitle you to a refund unless it meets the above criteria.

6. Device Compatibility

The Web App functions can be accessed on PC, laptop, tablet, and smartphone. However, there are specific requirements for the version of OS and web browser. Before purchasing a paid subscription, we strongly recommend using the free version to evaluate whether your device is capable of running the app.

We do not offer refunds based on compatibility issues, so please test the free version thoroughly before subscribing.

Users are responsible for maintaining compatible devices and software. We may update system requirements with prior notice.

7. Data Accuracy and Limitations

• Data accuracy: The data provided on the Web App, including information about color sets, paint properties, paint colors, and related content, is intended for informational purposes only. While we strive to maintain accurate and up-to-date information, users should be aware that the data may contain errors, omissions, or inaccuracies.
• Not professional advice: The data on the Web App is not intended to constitute professional advice, recommendations, or opinions in any field, including but not limited to art, painting, or any related discipline. Users should not rely on the data provided on the Web App as a substitute for seeking professional advice or expertise.
• Use at your own risk: Your use of the data on the Web App is at your own risk. We disclaim any liability for any actions taken or decisions made based on the data presented. Users are encouraged to independently verify any information obtained from the Web App before making any decisions or taking any actions.
• Limitations of sRGB color space: The Web App heavily utilizes the sRGB color space for calculations, which has a limited color gamut. As a result, some colors, especially those outside the sRGB color gamut, may not be accurately represented on the Web App. Users should be aware that colors displayed on the Web App may not precisely match real-world colors due to the limitations of the sRGB color space. Calibrate your monitor regularly to ensure proper color accuracy. For critical color work, we recommend using physical samples to verify colors.
• Consult experts: If you require precise or expert advice on color sets, paint properties, paint colors, or related matters, we strongly recommend consulting with knowledgeable experts or professionals who can provide tailored guidance based on your specific needs and circumstances.
• Dataset and algorithms updates: The Web App may update or revise its datasets, color libraries, or algorithms at any time without prior notice. These changes are intended to enhance accuracy and user experience.

8. Disclaimer of Warranties

The Web App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not make any representations or warranties regarding the accuracy, completeness, reliability, or suitability of the Web App for your specific needs.

We do not guarantee that the Web App will be available at all times or that it will be error-free. While we strive to provide a reliable and seamless user experience, interruptions, outages, and technical issues may occur. Your use of the Web App is subject to occasional downtime for maintenance, updates, or other reasons beyond our control. We shall not be liable for any inconvenience, loss, or damage resulting from the unavailability or errors in the Web App. Your use of the Web App acknowledges and accepts the possibility of such interruptions and errors.

9. Limitation of Liability

We, the creators and maintainers of the Web App, shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Web App.

Your use of the Web App is at your own risk, and we make no guarantees that the Web App will meet your requirements, be error-free, or operate without interruptions. We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages or any loss of profits or data, whether incurred directly or indirectly, arising out of your use or inability to use the Web App.

The collection and handling of user data is described in our Privacy Policy. We take privacy seriously and adhere to strict data protection practices. By using the Web App, you consent to the practices described in our Privacy Policy.

Please note: Images imported for processing are not stored on our servers; they are processed directly in the browser, ensuring privacy.

Users may terminate accounts via the Account page. All data may be deleted upon termination per our Privacy Policy.

• Third-party trademarks: Throughout the Web App, you may come across product and company names that are trademarks or registered trademarks of their respective owners. Any such trademarks or registered trademarks are the property of their respective holders. Unauthorized use of trademarks, logos, or branding is strictly prohibited. All trademarks and logos are the property of their respective owners.
• Fair use: The use of these trademarks or registered trademarks on the Web App is for identification purposes only and does not imply any endorsement, affiliation, or sponsorship by the respective trademark owners. We acknowledge the rights of trademark owners and use their marks in a manner consistent with fair use and applicable trademark laws.
• No challenge to trademarks: We do not intend to challenge the validity of any trademarks or registered trademarks used on the Web App. The inclusion of these trademarks or registered trademarks is not intended to create confusion or to suggest that we are associated with, sponsored by, or endorsed by the owners of these trademarks.
